Is the us of transitional justice accurate for Colombia¡a's peace process?
This days Colombia is celebrating the pinnacle of their efforts aimed at maintaining peace and face a globalized world governed by international law and Universal Human Rights.
However, though of its polemic tone within human rights, there are some judgements. But how can one commit more with serving to humanitarian law if it isn’t with transitional justice to preserve peace at all cost, bearing in mind that that’s the principal objective of the United Nations.
Colombia’s peace treaty embraces thoroughly many substantial topics for a proper social and economical development, such us comprehensive reform in rural areas, investments on infrastructure, education and health, rural reserves, update of the “Catastro Rural”, axis against drug crops and so on. But on this committee we comprehend a specific topic, which is transitional justice serving to peaceful alternatives to fight impunity and violation of human rights.
Now lets talk about Justice, Retrieval and truth. In accordance to the plan to fight impunity, Colombia will create a truth commission and a unit for missing civilians, in which 11 members will participate including maximum 3 foreign members.
On the negotiating table in the Havana delicate rights of victims of armed conflict were treated based on four axes: Justice, truth, reparation and guarantees of non-repetition. The heart of this agreement is a complex transitional justice system parallel to the traditional one, with the active participation of victims. It aims that, ultimately, these are repaired and that the truth of what happened in war is revealed under a principle known as " Repair the damage and restore when possible “. This judicial system has five organs, headed by a peace court, composed of twenty judges that will have the last word for perpetrators of crimes against humanity.
Taking into account the recommendations of the exam room of truth, it will be evaluated if the cases fall between those that can be of amnesty or pardon.
However the room will grantee amnesty in cases of those convicted or investigated for crimes that fall as political and related. If of the case doesn’t fall into the frame of pardon they shall be forwarded, unavoidably, to the court.
Those who are forwarded to the court of peace are those cases in which human integrity has been threatened or simply those that fall into the category of “Lessa Humandiad” crimes; likewise, there would be a proper punishment of 15 to 20 years of jail. Although cases on which perpetrators confess their crimes before trial will have some benefits such as penalty abatement or effective restriction probation.
Victims will be compensated with FARC financing to the retribution fund, the apology from the perpetrators, psychological assistance on welfare social institutes, community plans, return of displaced peasants, victimizers work for remunerations and the policy applied for those victims that require special need to favour form the land fund.
So is transitional justice accurate for this process? i think it really does

In my opinio transitional justice is accurate for Colombian Peace Process, due to the fact that set of judicial and non-judicial measures that have been implemented by different countries in order to redress the legacies of massive human rights abuses and taking into account that now Colombia is in an post conflict escenario, transitional justice most be used for judge the ex FARC members.
